Terms of Service

 
  • Commissions are to be discussed via email (falsemindstudios at gmail.com) or via discord.

    Digital images provided will be in JPG, PNG or other single layer format. The original files will not be included.

    Animations will be provided in GIF format.

    All traditional artwork will be mailed to an address provided by the client.

    Full resolution images will be emailed to the invoice email unless other arrangements are made.

    I will take digital commissions for figures ( fantasy, sci-fi, superhero, animal, anthro and monstrous) landscapes, weaponry and equipment, machinery, concept art and fan art.

    Violence, body horror, risqué scenarios and other mature work will require discussion.
    I will not take commissions of a sexually explicit nature.

  • After initial discussion about a commission, exchange of references, expectations and initial payment, a sketch will be produced and sent to the client. At artist discretion, multiple sketches may be presented for the client to decide upon.

    At this point the client will be asked to clarify any major changes and smaller details previously undecided. Typically any references are not copied directly. I will apply artistic interpretation to designs and poses as I see fit. If a reference is to be followed exactly, this must be articulated.

    During the process, 2-5 more updates of the Work in Progress will be provided, dependent on complexity of the piece and adjustments desired. These WIP images may be lower resolution than the final piece.

    From completed payment to completed commission is typically 7 days or less. Major changes may adjust this timeframe, especially those that occur later in the process. Changes later in the process may or may not adjust the final cost at artist discretion.

    Typical waitlist for commissions is 4-8 weeks. Rush jobs are available for a small fee.

    Upon completion, a jpg, png or gif will be sent to the client.

  • The nature of traditional art, be it color pencil, painting or sculpting, is inherently unique to the piece of art produced. This is a loose guideline for expectations. Note that traditional pieces may be broken up into multiple payments, to be discussed between the artist and client.

    The artist and client will discuss the commission subject, media and expectations. References, concepts and details will be discussed to provide a clear picture of the desired end result.

    After initial payment is complete, sketches (for 2d art) or sculptural sketches (for 3d art) will be sent to the client for discussion and feedback. At this time, the completion of payment or next stage of payment will be expected as discussed.

    Multiple updates will be provided on the Work in Progress, allowing for client feedback.

    Upon completion of the commission, the art will be mailed to the client upon payment of shipping and handling fees. These may be predetermined based upon the commission, or may be determined afterwards once final weight and dimensions are determined. Example: There is a standard shipping rate for most commissions on paper, be they graphite, color pencil or marker. Canvas and sculpture sizes and weights vary wildly, and the exact cost will be determined post completion.

  • Payment is only accepted through Paypal Invoice from Falsemind studios.

    All payments are to be in USD.

    Projects under 50 USD are to be paid in advance.

    Projects over 50 USD are to be paid in half before work begins and completed within 1 week of initial sketch delivery.

    By paying for a commission invoice, the client is claiming responsibility for being the cardholder of any payment methods used.

    If the scope or direction of a commission changes drastically, fees may apply to reflect the new commission design.

    Shipping of traditional artwork, including pencil drawings, paintings and sculptures will be included in invoices as required.

  • Commissions come in three varieties

    Personal Use Commissions are pieces a client is free to use in private and personal fashion. Printing, display, use as avatars on forums. I, the Artist, retain full rights to these pieces of art. The sale of these commissions as or in a product or other commercial function by the client is not allowed. If a client desires to to use a commission commercially, this is to be discussed with the artist and proper fees applied. This is the baseline price for commission rates.

    Commercial Use Commissions are pieces a client intends to use for commercial purposes or sale. Examples would include merchandise production, imagery for use in TV, film, video games, publication or advertisement, as well as other profit scenarios. All functions to generate profit directly or indirectly falls into this category. I, the artist, retain the ownership of the commission for personal and commercial use, including use in portfolio and social media. The fee for this type of commission is up to 100% on top of the original price.

    Exclusive Rights Commissions are commissions giving the client full rights to a commission. I, the artist, retain right to display a piece for portfolio purposes. By request of the client, this may be restricted to public or professional portfolio. The fee for this type of commission is 200% on top of the original price.

  • Prior to payment, a piece may be cancelled by the client.

    After the initial payment, the client may not demand a refund from me, the artist. If a client no longer wishes to continue with a piece, the initial payment is nonrefundable.

    I, the artist, reserve the right to reject or cancel any commission for any reason. If the cancellation is no fault of the client, any payments may be refunded. If the cancellation is the fault of the client, any payments will not be refunded. Reasons include, but are not limited to, abuse, lack of respect, changing the scope of the project.
